These Terms & Conditions (“Terms”) govern your use of Bitbull HMS (“the Software”) and related services provided by Bitbull Technologies Pvt. Ltd. (“we”, “us”, “our”). By downloading, installing, activating, or using the Software, you agree to these Terms. If you do not agree, do not use the Software.

1. License grant

Subject to payment of applicable fees and compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on the number of computers and for the term specified in your license agreement or purchase confirmation. You may not sublicense, rent, lease, sell, or distribute the Software except as expressly permitted in writing by us.

2. Restrictions

You agree not to:

  • Copy, modify, reverse engineer, decompile, or create derivative works of the Software except where law expressly permits and cannot be waived;
  • Remove or alter copyright, trademark, or proprietary notices;
  • Use the Software for unlawful purposes or in violation of healthcare, privacy, or data-protection laws;
  • Share license keys publicly or use a single license beyond the permitted number of installations;
  • Attempt to bypass license verification or technical protection measures.

3. Your responsibilities

You are solely responsible for:

  • All data entered, processed, and stored using the Software, including patient and financial records;
  • Maintaining regular backups and disaster-recovery procedures;
  • Hardware, operating system, network, printers, and third-party integrations;
  • Staff training, access control, and accuracy of clinical and billing decisions;
  • Compliance with laws and regulations applicable to your facility.

4. No medical or professional advice

The Software is a administrative and operational tool. It does not provide medical advice, diagnoses, or treatment recommendations. Clinical decisions remain solely between qualified healthcare professionals and patients. You must verify all prescriptions, reports, and billing outputs before use.

5. Disclaimer of warranties

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted or error-free operation.

We do not warrant that the Software will meet your requirements, that operation will be secure or free from viruses, that defects will be corrected, or that data will not be lost or corrupted.

6. No guarantee of data

WE DO NOT GUARANTEE THE INTEGRITY, AVAILABILITY, OR RECOVERY OF ANY DATA. All patient, financial, and operational data is stored on your systems unless you use a separate backup or service we explicitly provide. You acknowledge that hardware failure, user error, malware, power loss, or software bugs may cause partial or total data loss, and that you bear full responsibility for backups and data protection.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BITBULL TECHNOLOGIES PVT. LTD. AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business interruption, arising out of or related to your use of or inability to use the Software, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid to us for the Software license in the twelve (12) months preceding the claim, or one hundred Indian Rupees (INR 100) if no fee was paid, whichever is greater, except where such limitation is prohibited by law.

8. Indemnification

You agree to indemnify and hold harmless Bitbull Technologies Pvt. Ltd. from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Software, your data, your violation of these Terms, or your violation of any law or third-party rights.

9. Updates and changes

We may release updates, patches, or new versions at our discretion. We may modify or discontinue features without liability. Continued use after an update may constitute acceptance of changed functionality where permitted by law.

10. Termination

We may suspend or terminate your license if you breach these Terms, fail to pay fees, or misuse the Software. Upon termination, you must stop using the Software and destroy copies where required; sections that by nature should survive (disclaimers, limitation of liability, indemnity) will survive.

11. Refunds

All sales are subject to our Refund Policy (no refunds except where mandatory law requires otherwise).

12. Privacy

Our handling of limited information is described in the Privacy Policy.

13. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in India shall have exclusive jurisdiction over disputes, subject to mandatory consumer protections in your country of residence where applicable.

14. Entire agreement

These Terms, together with the Privacy Policy, Refund Policy, and your license purchase details, constitute the entire agreement regarding the Software and supersede prior oral or written understandings on the same subject.
